Arma Insurgency – EULA

This End User License Agreement (“EULA”) is a legal agreement between you (either an individual or an entity, referred to as “You” or “User”) and Integrity Gaming Group (“Licensor”) governing the use of the Arma Insurgency game mode (“Software”). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.

1. GRANT OF LICENSE

Subject to the terms and conditions of this EULA, Licensor grants you a limited, non-exclusive, non-transferable, and revocable license to use the Software solely for personal, non-commercial purposes in accordance with the restrictions set forth herein.

2. RESTRICTIONS

You agree to the following restrictions:

  • No Derivative Works or Modifications: You may not modify, adapt, create derivative works of, or otherwise alter the Software in any way.
  • No Reverse Engineering: You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except in anyway required by the Arma Reforger game in order to use the Software as a player.
  • No Commercial Use: You may not use the Software for any commercial purpose, including but not limited to selling, licensing, renting, offering paid services, or engaging in any form of “donation” schemes that provide access or benefits related to the Software.
  • No Use by Military Organizations: The Software may not be used by any military organization, government entity, or any group or individual for training or operational purposes.
  • No Unauthorized Public Hosting: The Software may not used by hosted on any public servers within Arma Reforger unless and until Licensor announces a full public release and grant for such hosting. Prior to such an announcement, hosting is only permitted for servers with explicit approval from Licensor.
  • Workbench: The Software may not be re-uploaded to the Arma Platform Workshop, regardless of any status or public access.
  • Attribution Required: The Software shall include all attribution as included within the Software regardless of any uses that may be unauthorized or deemed void.
  • Authorized Usage: You may play the Software only when connecting to a server that has received approval to host the Arma Insurgency game mode.

3. INTELLECTUAL PROPERTY RIGHTS

The Software, including but not limited to all copyrights, trademarks, trade secrets, and other intellectual property rights, is and shall remain the exclusive property of Licensor. This EULA does not grant you any ownership rights in the Software, only a limited license to use it under the terms stated herein.

4. TERMINATION

This EULA is effective upon your installation or use of the Software and shall remain in effect until terminated and/or are updated by Licensor. Your rights under this EULA will terminate automatically without notice if you fail to comply with any terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession. Should any single part of this license be found to be null/void by a superseding provision under any license or agreement from Bohemia Interactive, such provision does not void or nullify all provisions of this EULA.

5. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED. YOUR USE OF THE SOFTWARE IS AT YOUR OWN RISK.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THIS EULA OR YOUR USE OF THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. GOVERNING LAW

This EULA shall be governed by and construed in accordance with the laws of the United States of American, State of Delaware, without regard to its conflict of law principles. Any disputes arising from or relating to this EULA shall be resolved in the courts of United States, State of Delaware.

8. CHANGES TO THIS AGREEMENT

Licensor reserves the right to modify this EULA at any time. Continued use of the Software after any such changes constitutes acceptance of the modified terms.

9. OTHER TERMS

The Licensor shall not be bound by any additional or different terms or conditions communicated by You unless expressly agreed.

Any arrangements, understandings, or agreements regarding the Licensed Material not stated herein are separate from and independent of the terms and conditions of this EULA.

To the extent possible, if any provision of this EULA is deemed unenforceable, it shall be automatically reformed to the minimum extent necessary to make it enforceable. If the provision cannot be reformed, it shall be severed from this EULA without affecting the enforceability of the remaining terms and conditions.

No term or condition of this EULA will be waived and no failure to comply consented to unless expressly agreed to by the Licensor.

Nothing in this EULA constitutes or may be interpreted as a limitation upon, or waiver of, any privileges and immunities that apply to the Licensor or You, including from the legal processes of any jurisdiction or authority.
